1. Acceptance (Required to Enter)
By clicking "I Agree" (or similar), and/or by submitting any photo(s), video(s), text, or other content through themayerharmanteam.com including the GBM 2025 submission page (the "Submission Page"), you confirm you have read, understood, and agree to these Terms. If you do not agree, do not submit and do not enter.
These Terms are a condition of participation in GBM 2025.
2. Definitions
- "We", "Us", "Our", "MHT" means The Mayer-Harman Team.
- "Released Parties" means MHT, Bradley Mayer-Harman, Lianna Mayer-Harman, their brokerage and affiliated real estate entities, and each of their past, present, and future parents, subsidiaries, related companies, affiliates, advertising and marketing partners, prize sponsors, licensors, licensees, successors and assigns, and all of their respective owners, directors, officers, employees, contractors, agents, and representatives.
- "Content" means anything you submit or provide in connection with GBM 2025, including (without limitation) your gingerbread creation photo, optional family/team photo, any captions, comments, names, social handles, profile links, likenesses, voices, and any other materials.
- "Submission" means your upload and/or entry into GBM 2025.
3. Eligibility and Authority
You represent and warrant that:
- You are at least the age of majority where you live (18+ in most provinces), and you have full legal capacity to agree to these Terms; or
- If any minor(s) appear in the Content (including in a family or team photo), you are the parent/legal guardian of each minor appearing, and you provide this consent and release on your own behalf and on behalf of each minor.
If multiple people appear, you confirm you have obtained their permission (or are authorized to provide permission) for the Content and the rights granted below.
4. Your Grant of Rights
You grant to the Released Parties an irrevocable, perpetual, worldwide, royalty-free, fully-paid, sublicensable, transferable licence to use the Content for any purpose connected to the Released Parties' business and promotions, including (without limitation) advertising, marketing, social media posting, website display, email marketing, newsletters, CRM marketing, testimonials, print materials, listing presentations, community promotions, and contest promotion and administration, in any media now known or later developed.
This licence includes the right to:
- reproduce, copy, store, host, publish, distribute, communicate to the public, publicly display, publicly perform, broadcast, stream, and otherwise make the Content available;
- edit, crop, resize, retouch, add text/graphics, blur, anonymize, combine with other content, create derivative works, and otherwise modify the Content; and
- use your name (first name and last initial if we choose), city, and social handle(s) alongside the Content (or without any credit), at our sole discretion.
You acknowledge that:
- You will not be paid for any use of the Content, and no compensation is owed now or in the future.
- The Released Parties have no obligation to use the Content, and may remove, refuse, or discontinue use at any time, but are not required to do so.
5. Moral Rights Waiver
To the fullest extent permitted by law, you waive in whole and in part any and all moral rights you may have in the Content (including rights of integrity, attribution, association, and anonymity) in favour of the Released Parties and anyone authorized by them to use the Content.
6. Your Promises (Representations and Warranties)
You represent, warrant, and agree that:
- You own the Content or you have obtained all necessary rights, permissions, and licences to submit it and to grant the rights in these Terms.
- The Content does not infringe any copyright, trademark, privacy, publicity, moral rights, or any other rights of any person or entity.
- The Content does not contain confidential information or anything unlawful, defamatory, or abusive.
- Any people shown in the Content have consented (and if minors are shown, you are their parent/legal guardian or otherwise authorized to consent).
7. Release of Claims
To the fullest extent permitted by law, you release, waive, and forever discharge the Released Parties from any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to:
- the use, publication, display, modification, or other exploitation of the Content;
- any alleged infringement of copyright or moral rights, or violation of privacy, personality, or publicity rights; and
- your participation in GBM 2025.
You agree not to sue, not to initiate, and not to participate in any claim against any Released Party relating to the Content or these Terms.
8. Indemnity
You agree to indemnify and hold harmless the Released Parties from and against any claim or demand (including reasonable legal fees) made by any third party arising out of:
- your Content,
- your breach of these Terms, or
- any allegation that the Content or its use violates rights of any person or entity.
9. Privacy Notice for GBM 2025 Submissions
We collect personal information you submit on the Submission Page such as: name, email, phone, address, city, province, postal code, optional notes, optional junior builder names, and optional social handles and profile links, plus the uploaded photo(s). (The Mayer-Harman Team)
Purposes: We collect and use this information to:
- administer GBM 2025 (validate entries, contact entrants, contact winners, deliver prizes);
- prevent fraud and ensure contest integrity;
- publish and promote the contest and the Released Parties, including by posting Content on websites and social channels; and
- communicate with you about GBM 2025 and, where permitted, our services.
Service providers: We may share information with vendors who help us run our website, store files, run analytics, operate forms, and manage communications (for example, hosting, cloud storage, CRM, email tools), strictly as needed for these purposes. Data may be processed or stored outside your province or Canada depending on service provider location.
Legal: We may disclose information as required by law, regulation, or legal process.
Consent: By submitting, you provide consent for collection, use, and disclosure for the purposes described above, consistent with Canadian private-sector privacy principles on consent and meaningful notice. (Office of the Privacy Commissioner)

10. Social Media Platform Disclaimer

11. Limitation of Liability
To the fullest extent permitted by law:
- the Released Parties will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages; and
- total liability arising from or related to the Submission or these Terms will not exceed $10 CAD.
12. Governing Law, Forum, and Time Limit to Bring Claims
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles.
To the fullest extent permitted by law:
- you agree that any dispute must be brought exclusively in the courts located in Ontario, Canada, and you attorn to that jurisdiction; and
- any claim must be filed within one (1) year after the event giving rise to the claim, otherwise it is permanently barred.
13. We Can Update These Terms
We may update these Terms at any time by posting an updated version on our website. The version in effect at the time of your Submission applies to that Submission.
14. Entire Agreement, Severability, Assignment
These Terms, together with any posted contest rules referenced on the Submission Page, are the entire agreement regarding the Submission. If any provision is found unenforceable, the remaining provisions remain in effect. We may assign these Terms and the rights granted to any Released Party or successor without notice.

1) Agreement to Official Rules
By participating in the Contest, each participant ("Entrant") fully and unconditionally agrees to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all matters related to the Contest. The Sponsor reserves the right to interpret these Official Rules and resolve any disputes at its sole discretion.
2) Contest Period
The Contest begins on November 1, 2025 and ends on December 25, 2025 at 11:59:59 PM ET (the "Contest Closing Date"). The Mayer-Harman Team+1
The random draw will take place December 28, 2025 at 6:00 PM ET (the "Draw Date"). The Mayer-Harman Team+1
Sponsor's computer systems are the official timekeeping device.
3) Eligibility
The Contest is open to legal residents of Canada who have reached the age of majority in their province/territory of residence at the time of entry.
Not eligible: employees, agents, and representatives of the Sponsor and its affiliated entities, and members of their immediate family (spouse, parents, siblings, children) and persons living in the same household. Residents of Quebec are not eligible.
4) How to Enter (No Purchase Necessary)
No purchase is necessary to enter or win. A purchase will not increase chances of winning.
You may enter in either of the following ways:
(A) Online Photo Submission (recommended):
Complete the submission form at https://www.themayerharmanteam.com/submission-gbm-2025 and upload your photo(s) as prompted. The Mayer-Harman Team
(B) Email Submission (alternate):
Email your entry photo to info@themayerharmanteam.com by the Contest Closing Date. The Mayer-Harman Team+1
All entries must be received by the Contest Closing Date to be eligible. The Mayer-Harman Team+1
5) Entry Limits
Limit one (1) entry per household during the Contest Period, unless Sponsor specifies otherwise in writing. If multiple entries are received from the same household, Sponsor may, in its sole discretion, accept only the first valid entry received and void the remaining entries.
6) Entry Requirements (Photo Content Rules)
To be eligible, your entry must:
- be your original submission (or you have all required rights/permissions to submit it),
- not include anything unlawful, defamatory, hateful, or obscene,
- not infringe any third-party rights (copyright, privacy, publicity, trademark, etc.),
- comply with these Official Rules.
Sponsor may disqualify any entry at any time if Sponsor determines (in its sole discretion) that the entry violates these Official Rules or is otherwise inappropriate for publication.
7) Bonus Entry (Social Posting) — Optional
To maximize your chances, you may optionally post your gingerbread creation photo to your public social feed and tag @themayerharmanteam as described on the submission flow. The Mayer-Harman Team+1
If you complete the optional social post/tag step, you will receive one (1) bonus entry, for a total of two (2) entries (one submission entry + one bonus entry).
Bonus entries must be completed by the Contest Closing Date.
Important disclosure: This bonus entry is a "fact that materially affects the chances of winning" and is disclosed here for compliance.
8) Prizes; Approximate Retail Value; Odds
Prizes are as follows (insert your actual list):

Odds of winning depend on the number of eligible entries received during the Contest Period.
These disclosures are required for Canadian promotional contests (number and approximate value of prizes, areas they relate to, and other facts that materially affect chances).
9) Winner Selection (Random Draw) and Skill-Testing Question (Canada)
On the Draw Date, Sponsor will conduct a random draw from all eligible entries received by the Contest Closing Date.
Selected entrant(s) must correctly answer a time-limited mathematical skill-testing question without assistance to be declared a winner (where required).
10) Winner Notification
Sponsor will attempt to contact the selected entrant(s) using the contact information provided at entry (email and/or phone). The Mayer-Harman Team+1
If a selected entrant:
- cannot be reached within [48–72 hours], or
- fails to answer the skill-testing question correctly, or
- fails to sign and return required documents (including a release), or
- is otherwise found ineligible,
then Sponsor may disqualify that entrant and select an alternate entrant by random draw.
11) Prize Conditions
Prizes must be accepted as awarded. No substitutions except at Sponsor's sole discretion. Sponsor may substitute a prize or component with one of equal or greater value for any reason. Prizes are non-transferable, non-refundable, and not redeemable for cash unless Sponsor states otherwise in writing.
Sponsor is not responsible for lost, late, misdirected, incomplete, illegible, or damaged communications.
12) Release, Publicity, and Image/Content Licence (Required to Participate)
As a condition of entry and/or receiving a prize, Entrant agrees to sign (if requested) Sponsor's release and confirms that by submitting an entry they grant Sponsor broad rights to use the submitted images and related information for promotion and marketing.
This aligns with platform promotion requirements that participants release the platform (e.g., Instagram/Facebook) and acknowledge the promotion is not sponsored/endorsed/administered by the platform. Instagram Help Center+1
13) Privacy / Personal Information
Sponsor collects personal information submitted in connection with the Contest (e.g., name, email, phone, address, uploaded images) to administer the Contest, contact entrants/winners, deliver prizes, and for promotional purposes where consent is provided. The Mayer-Harman Team+1
Entrants may withdraw consent to the collection/use of personal information, subject to legal or contractual restrictions and reasonable notice (and with the understanding that withdrawal may affect eligibility and does not impact already-published content).
14) Marketing Messages (CASL)
Contest administration messages (e.g., winner notifications) may be sent as needed. If Sponsor wants to send commercial electronic messages (marketing emails/texts), Sponsor will obtain consent as required under Canada's anti-spam law (CASL).
15) General Conditions; Sponsor Rights; Fraud
Sponsor reserves the right, in its sole discretion, to:
- cancel, suspend, modify, or terminate the Contest (or any part of it) at any time for any reason including fraud, technical failures, or any factor beyond Sponsor's reasonable control;
- disqualify any person it believes is tampering with entry procedures or otherwise violating these Official Rules;
- void any entries that are incomplete, inaccurate, forged, mechanically reproduced, or otherwise irregular.
16) Limitation of Liability
To the fullest extent permitted by law, Released Parties are not responsible for: technical failures; lost or incomplete entries; failures of networks/servers; or any injury/damage arising from participation or prize use.
17) Disputes; Governing Law; Venue; Class Action Waiver
These Official Rules are governed by the laws of Ontario and the federal laws of Canada applicable therein.
To the fullest extent permitted by law: (i) any disputes must be brought exclusively in Ontario; (ii) Entrants waive any right to participate in a class action; and (iii) Sponsor's decisions are final and binding.
