1. Acceptance (Required to Enter)
By clicking "I Agree" (or similar), and/or by submitting any photo(s), video(s), text, or other content through themayerharmanteam.com including the GBM 2025 submission page (the "Submission Page"), you confirm you have read, understood, and agree to these Terms. If you do not agree, do not submit and do not enter.
These Terms are a condition of participation in GBM 2025.
2. Definitions
- "We", "Us", "Our", "MHT" means The Mayer-Harman Team.
- "Released Parties" means MHT, Bradley Mayer-Harman, Lianna Mayer-Harman, their brokerage and affiliated real estate entities, and each of their past, present, and future parents, subsidiaries, related companies, affiliates, advertising and marketing partners, prize sponsors, licensors, licensees, successors and assigns, and all of their respective owners, directors, officers, employees, contractors, agents, and representatives.
- "Content" means anything you submit or provide in connection with GBM 2025, including (without limitation) your gingerbread creation photo, optional family/team photo, any captions, comments, names, social handles, profile links, likenesses, voices, and any other materials.
- "Submission" means your upload and/or entry into GBM 2025.
3. Eligibility and Authority
You represent and warrant that:
- You are at least the age of majority where you live (18+ in most provinces), and you have full legal capacity to agree to these Terms; or
- If any minor(s) appear in the Content (including in a family or team photo), you are the parent/legal guardian of each minor appearing, and you provide this consent and release on your own behalf and on behalf of each minor.
If multiple people appear, you confirm you have obtained their permission (or are authorized to provide permission) for the Content and the rights granted below.
4. Your Grant of Rights
You grant to the Released Parties an irrevocable, perpetual, worldwide, royalty-free, fully-paid, sublicensable, transferable licence to use the Content for any purpose connected to the Released Parties' business and promotions, including (without limitation) advertising, marketing, social media posting, website display, email marketing, newsletters, CRM marketing, testimonials, print materials, listing presentations, community promotions, and contest promotion and administration, in any media now known or later developed.
This licence includes the right to:
- reproduce, copy, store, host, publish, distribute, communicate to the public, publicly display, publicly perform, broadcast, stream, and otherwise make the Content available;
- edit, crop, resize, retouch, add text/graphics, blur, anonymize, combine with other content, create derivative works, and otherwise modify the Content; and
- use your name (first name and last initial if we choose), city, and social handle(s) alongside the Content (or without any credit), at our sole discretion.
You acknowledge that:
- You will not be paid for any use of the Content, and no compensation is owed now or in the future.
- The Released Parties have no obligation to use the Content, and may remove, refuse, or discontinue use at any time, but are not required to do so.
5. Moral Rights Waiver
To the fullest extent permitted by law, you waive in whole and in part any and all moral rights you may have in the Content (including rights of integrity, attribution, association, and anonymity) in favour of the Released Parties and anyone authorized by them to use the Content.
6. Your Promises (Representations and Warranties)
You represent, warrant, and agree that:
- You own the Content or you have obtained all necessary rights, permissions, and licences to submit it and to grant the rights in these Terms.
- The Content does not infringe any copyright, trademark, privacy, publicity, moral rights, or any other rights of any person or entity.
- The Content does not contain confidential information or anything unlawful, defamatory, or abusive.
- Any people shown in the Content have consented (and if minors are shown, you are their parent/legal guardian or otherwise authorized to consent).
7. Release of Claims
To the fullest extent permitted by law, you release, waive, and forever discharge the Released Parties from any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to:
- the use, publication, display, modification, or other exploitation of the Content;
- any alleged infringement of copyright or moral rights, or violation of privacy, personality, or publicity rights; and
- your participation in GBM 2025.
You agree not to sue, not to initiate, and not to participate in any claim against any Released Party relating to the Content or these Terms.
8. Indemnity
You agree to indemnify and hold harmless the Released Parties from and against any claim or demand (including reasonable legal fees) made by any third party arising out of:
- your Content,
- your breach of these Terms, or
- any allegation that the Content or its use violates rights of any person or entity.
9. Privacy Notice for GBM 2025 Submissions
We collect personal information you submit on the Submission Page such as: name, email, phone, address, city, province, postal code, optional notes, optional junior builder names, and optional social handles and profile links, plus the uploaded photo(s). (The Mayer-Harman Team)
Purposes: We collect and use this information to:
- administer GBM 2025 (validate entries, contact entrants, contact winners, deliver prizes);
- prevent fraud and ensure contest integrity;
- publish and promote the contest and the Released Parties, including by posting Content on websites and social channels; and
- communicate with you about GBM 2025 and, where permitted, our services.

11. Limitation of Liability
To the fullest extent permitted by law:
- the Released Parties will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages; and
- total liability arising from or related to the Submission or these Terms will not exceed $10 CAD.
12. Governing Law, Forum, and Time Limit to Bring Claims
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles.
To the fullest extent permitted by law:
- you agree that any dispute must be brought exclusively in the courts located in Ontario, Canada, and you attorn to that jurisdiction; and
- any claim must be filed within one (1) year after the event giving rise to the claim, otherwise it is permanently barred.
13. We Can Update These Terms
We may update these Terms at any time by posting an updated version on our website. The version in effect at the time of your Submission applies to that Submission.
14. Entire Agreement, Severability, Assignment
These Terms, together with any posted contest rules referenced on the Submission Page, are the entire agreement regarding the Submission. If any provision is found unenforceable, the remaining provisions remain in effect. We may assign these Terms and the rights granted to any Released Party or successor without notice.

GingerBRADman (GBM) Contest
1. What the Contest Is
- Name: GingerBRADman Gingerbread House Contest (GBM)
- Host: The Mayer-Harman Real Estate Team
- Purpose:
- Give back to families in our community
- Strengthen relationships with our clients and supporters
- Create a fun, low-pressure holiday tradition everyone can participate in
- Scale:
- Up to 1,000 free gingerbread house kits delivered or handed out each year
- Open to anyone in our community (with special recognition and perks for past/current clients)
2. Contest History / Spirit
- GBM has grown into one of our signature community events, alongside:
- Katherina Mayer Business & Entrepreneurship Scholarship
- Client BBQ
- Home & Garden Show
- Blues & Jazz Festival participation
- Airport Day
- The heart of the contest:
- It's not about "prettiest house," it's about participation, family time, and community connection.
- Any gingerbread house counts – it does NOT need to look perfect.
3. How the Contest Works (High-Level)
- People receive a gingerbread house
- Either via:
- Online sign-up on our website (free kits while supplies last), or
- In-person distribution at events (e.g., Santa Claus Parade, Christmas in the Park).
- If free kits are fully allocated, people can still participate by buying their own kit and entering with a photo.
- Either via:
- They build and decorate their gingerbread house at home.
- They submit their entry through our website (this is critical):
- They must upload at least one photo of their completed gingerbread house.
- They must provide their contact details (name, email, phone, address, possibly if they are a past/current client).
4. Rules for Ballots & Entries
A. Core Rule – How to Earn Your First Ballot
- You can only earn a ballot by submitting a photo through our website.
- Requirements for a valid entry:
- Photo of a completed gingerbread house (doesn't need to be fancy or professional).
- Submitted via our official contest form on the website.
- Submitted before the deadline: Christmas Day at 11:59 p.m.
- No website submission = no ballot, even if they got a free house.
B. Ways to Earn Additional Ballots
Once a valid photo entry has been submitted on the website, participants can earn extra ballots:
- Social Media Follows
- 1 ballot for following us on any of our social media accounts:

- Instagram: @TheMayerHarmanTeam
- TikTok: @MayerHarmanTeam
- (Optional: YouTube, LinkedIn – if you want to include those)
- 1 ballot for following us on any of our social media accounts:
- 5-Star Review (First Time Only)
- 1 ballot for leaving us a first-time 5-star review on:
- Google, or
- Only counts if it's their first review for us on that platform.
- 1 ballot for leaving us a first-time 5-star review on:
- Sharing & Tagging Post
- 1 ballot for sharing a post featuring their gingerbread house and tagging our team on one of our social channels.
- Bonus Ballot for Clients
- Automatic bonus ballot for all past or current clients of The Mayer-Harman Team.
- Reason: there would be no contest without the families who support our team and sponsors every year – this is our way of saying thank you.
5. Prizes & Draw Details
- Winners are selected on December 28th.
- Live Prize Draw:
- Time: 6:00 p.m. (or your preferred time) on December 28th
- Platforms: Facebook Live, Instagram Live, and TikTok Live
- Prizes:
- Multiple prize packages (e.g., "one of five prizes") – gift cards, family experiences, etc.
- Winners are chosen based on ballots, not how "good" their house looks.
- All ballots (website entry + extras) are pooled, and we draw winners during the live event.
6. Website Requirements (For Designer)
The contest page/form should include:
- Headline & Description
- Short explanation of GBM and the fact that any gingerbread house qualifies.
- Mention that ballots are based on actions, not appearance.
- Entry Form Fields
- Name (Required)
- Email (Required)
- Phone (Required)
- Address/City (Optional but preferred)
- "Are you a past or current Mayer-Harman Team client?" (Yes/No – for automatic bonus ballot)
- Photo upload field (Required – at least one image of the completed house)
- Consent/permissions checkbox (e.g., for using photos on social media, in marketing, etc.)
- Ballot Tracking Section (copy only – backend logic up to dev)
- Explanation of:
- 1 ballot = website photo submission (mandatory base requirement)
- +1 for following us on social media (one ballot total, not one per platform unless you want that)
- +1 for first-time 5-star review on Google or Facebook
- +1 for sharing & tagging us with their house picture
- +1 automatic bonus ballot for past/current clients
- Explanation of:
- Important Dates
- Photo submission deadline: Christmas Day at 11:59 p.m.
- Live draw date & time: December 28th on Facebook, Instagram, TikTok.

- "Does my house have to look professional?" → No, just have fun and submit a photo.
- "Can I still join if I didn't get a free house?" → Yes, buy your own kit and submit a photo.
- "How will I know if I won?" → Winners announced live and contacted directly via email/phone.
7. Internal Roles & Responsibilities (For Your Team)
- Brad / Mayer-Harman Team
- Overall contest host and face of the brand.
- Promotes the contest on social and during live events.
- Hosts the December 28th live draw.
- Lianna / Admin Team
- Manages sign-ups and confirms entries in the backend.
- Helps verify:
- Who submitted photos
- Who is a past/current client
- Who qualifies for extra ballots (follows, reviews, shares).
- Drivers / Volunteers
- Deliver free gingerbread houses to sign-up addresses.
- Use provided address labels and optimized delivery routes.
- Sponsors
- Contribute prizes or financial support.
- May be recognized on the website, social posts, and during the live draw.
